It is expressly agreed that Suttner America’s liability hereto shall in no event exceed the purchase price paid for any defective goods and Suttner America’s sole obligation and the buyer's exclusive remedy, shall be limited, at Suttner America’s election, to Suttner America’s repairing, replacing, or refunding the purchase price of the defective goods.

In no event shall Suttner America be liable for any damages, including but not limited to loss of use and loss of profits, caused by any defect in the goods sold hereto, whether such damages occur, or are discovered before or after repair or replacement. Moreover, all consideration of warranty is subject to inspection and evaluation of warranty claim goods at Suttner America’s facility in Dubuque, Iowa.
